1. scope of application
The present general terms and conditions (GTC), regulate the relationship between the customer and TheBuyAndSellStore.
If individual agreements in individual cases contradict these terms and conditions, the individual agreements in written form take precedence.
2. prices
The prices in TheBuyAndSellStore are shown in CHF excluding VAT. Not included are the costs for packaging and shipping,
which may vary according to the size and packaging of the product.
3. terms of payment
Unless otherwise agreed, payment in advance is generally valid. Under the heading payment information you can see our payment options. The amount for a reserved or prepaid item must be paid in full within 7 days to the specified account. Otherwise the reservation expires. The prepayment will be refunded minus the operating costs incurred.
4. examination and sale
The purchased goods are conscientiously controlled and offered. Since the offered goods are also second-hand goods, minor defects may occur. Our articles are checked to the best of our knowledge and belief for originality. We guarantee not to offer copies.
5. shipping
The delivery of the articles is made against invoice (only for returning customers), payable within 10 days after receipt of the goods. For first-time customers, delivery is made against advance payment. New customers must select the option prepayment or surname. Orders will only be shipped after receipt of payment. If the item is no longer available, the money will be refunded. The items remain the property of TheBuyAndSellStore until they are paid. We ship all packages through the Swiss Postal Service via PostPac Priority. The postage costs are between CHF 9.00 and CHF 25.00 depending on the weight of the parcel. The postage costs will be adjusted to the current price situation of the Swiss Post if necessary. You can find more information about postage costs on the homepage of the Swiss Post under www.post.ch. Ordered items will be delivered within 2 to 4 working days for items that are in stock or available. Delivery backlogs are carried out within 2 to 3 weeks. For products that are ordered or manufactured especially on customer request, the delivery time may be longer than specified. Shipping costs for foreign countries are calculated individually. The packaging material is provided by us. Since all products from abroad must be paid in US dollars, we reserve the right to adjust the prices according to the exchange rate to the Swiss currency.
Orders that have not been picked up after consultation will be put back for 7 days. We reserve the right to charge for any possible compensation for inconvenience.
6. conditions of purchase
- Minimum age 18 years or accompanied by a legal representative
- Proof of identity by means of a valid identity card
- Proof of ownership of the item to be sold (purchase receipt, certificates etc.)
- possibly proof of a residence in Switzerland for possible queries
7. commission sale
We display your goods in our store and online and have a percentage of your sales price.
The term for the commission order is minimum 1 month and maximum 3 months.
The principal can offer a maximum of 5 items without fees. However, it is possible to make a different individual agreement for more than 5 items. In this case, fees may apply.
If the commission period has expired, no request for renewal has been received and we have contacted you 3 times without success, the goods will be kept safely in stock for 3 months for a placement fee which must be paid for the release. If no other arrangements have been made, the item will become our property after this period has expired. There is then no claim to financial compensation.
8. right of return and exchange (mandatory invoice number)
Within a period of 5 days from delivery/receipt of the goods (Firsthand-Aritkel) the customer has the right to revoke the conclusion of the contract without giving reasons and to return the goods;
in this case TheBuyAndSellStore will return payments made step by step against return of the goods. Excluded from the right of return are second-hand articles, cases in which the goods were manufactured according to customer specifications or which are not suitable for return due to their nature. In case of a delivery in several parts, the beginning of the return period is extended until you have received the remaining delivery(s). The purchase amount minus the expenses incurred will be refunded.
Please contact the company in advance. In exceptional cases the warranty is provided by TheBuyAndSellStore.
9. disclaimer of liability
TheBuyAndSellStore assumes no liability. Neither the Company nor any of its directors, employees or agents in any way shall be liable for any direct or indirect loss, liability, costs, claims, demands, expenses or damages of any kind, whether in contract, tort or otherwise, arising out of or relating to the use of this article. This includes liability for negligence and applies even if the Company was informed of the possibility of such consequences.
10. data protection
TheBuyAndSellStore is entitled to process and store data received in the context of the business relation with the customer in the sense of the Data Protection Act in the customer data base, but not to pass them on to third parties.
11. place of performance, applicable law and jurisdiction
Unless otherwise specified, the place of performance of services under this contract shall be St. Gallen.
The contractual relations between TheBuyAndSellStore and its contractual partners are subject to Swiss law, if these terms and conditions do not provide for own regulations. The place of jurisdiction for all disputes arising from the contractual relationship is St. Gallen.
